Chemical Product Safety Act, and Occupational Safety and Health Act.

Overview

If a foreign manufacturer or exporter does not provide information on the substance being imported for reasons of data protection, the importer fails to comply with the obligations of pre-declaration, registration, information transfer, and product declaration under the K-REACH.
To solve this problem, the K-REACH provides that a person who intends to manufacture or produce chemicals or products imported into Korea from overseas (overseas manufacturer or producer) may appoint a person who meets the requirements set forth in the MOE Decree (OR, Only Representative) to perform duties on behalf of the person who intends to import the chemicals or products.

OR’s Roles & Responsibilities

  • Inquire whether a chemical has been registered or not
  • Notification, registration, and exemption verification of new chemical substances
  • Pre-declaration of existing chemical substances, notification of changes
  • Registration of chemicals and changes to chemicals
  • Confirm whether existing data has been used for K-REACH or not
  • Sale of overseas data, negotiation, and operation of LOA shop
  • Independent submission for joint registration (Opt-Out)
  • Consent to use vertebrate test data
  • Provide information about downstream users of registered substances
  • Production of test data and survey on uses of downstream users
  • CBI Application
  • Notify products containing substances subject to intensive control and provide relevant information

Any person appointed as an only representative must report to the relevant authorities that they have been appointed or removed by the foreign manufacturer or producer. The agent's legal liability for any violations is as follows.

Violations Legal liability
  • Failing or falsely fulfilling registration obligations for new or existing chemicals
  • Failure to register a change or fraudulent registration of a change
  • Failure to report or falsely report small quantities and manufacturing or importing new chemicals
  • Failure or false fulfillment of notification obligations for products containing substances subject to intensive control
Imprisonment for up to 5 years or a fine of up to KRW 100 million
  • Manufacturing or importing new or existing chemicals without applying for exemption such as registration
  • Failure to submit data or submission of false data in violation of the order to submit data on the results of hazardous assessment and risk assessment
Imprisonment for up to 3 years or a fine of up to KRW 50 million
  • Failing to provide or misleadingly providing information about chemicals in the supply chain
  • Failing to provide or misleadingly providing information about the safe use of a product to consumers.
Imprisonment for up to 1 year or a fine of up to KRW 30 million
